The employer must offer a job to a foreign national before the work permit can be applied for. The employer must have attempted to fill the job position by a Canadian or provide adequate proof to Human Resources and Skills Development Canada (HRSDC) that the job cannot be filled by a Canadian at that time.
Once HRSDC has given their labour market opinion the employer should advise the foreign national of the status. If HRSDC grants permission to the employer to hire a foreign national the employer should advise the foreign national to make an application to CIC for a work permit.
The employer is responsible for ensuring all workers have the necessary work permits. Foreign workers are given a Social Insurance number which begins with a number nine. Having a Social Insurance Number of this type is not evidence of a valid work permit.
Work permits have conditions which must be adhered to.
